RE: The tariff classification of woven fiberglass fabric from China.

Dear Mr. Liu:

In your letter dated October 16, 2015, you requested a tariff classification ruling on behalf of your client, New Fire Co., Ltd.

The merchandise under consideration is item number RLF3011, described as “Glass Fiber Cloth with Dyeing Coated.” A sample was submitted with your ruling request and will be returned to you.

From the information you provided, the Glass Fiber Cloth with Dyeing Coated is a woven fabric, black in color, comprised of fiberglass filament yarns, with filaments 9 microns in diameter. It weighs 450 grams per square meter, and is imported in rolls which measure either 38 inches by 50 yards or 60 inches by 50 yards. After importation, you state that this fabric will be cut and sewn into applications such as a welding blanket, a fire blanket, or the outer cover of a thermal insulation jacket.

In your ruling request you suggest classification of the Glass Fiber Cloth with Dyeing Coated in 7019.59.7000, Harmonized Tariff Schedule of the United States (HTSUS) as colored fiberglass tire cord fabric woven from electrically nonconductive continuous fiberglass filaments 9 microns in diameter to 11 microns in diameter and impregnated with resorcinol formaldehyde latex treatment for adhesion to polymeric compounds. However, you have indicated that this article does not contain any resorcinol formaldehyde latex adhesives. Classification in 7019.59.7000, HTSUS, is therefore precluded.

The applicable subheading for item number RLF3011, “Glass Fiber Cloth with Dyeing Coated,” will be 7019.59.9021, HTSUS, which provides for “Glass fibers (including glass wool) and articles thereof (for example, yarn, woven fabrics): Other woven fabrics: Other: Colored: Other: Weighing more than 215 grams per square meter, with a filament diameter of 7 to 13 microns.” The general rate of duty will be 7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
